Forest Capital Partners, LLC is looking for a Land Use Specialist to join our team.
Responsibilities
Specific responsibilities include but are not limited to the following:
• Support regional forest operations and land sales activities in connection with matters related to legal ownership and real estate property.
• Support identification and resolution of access issues related to forest operations.
o Review operational plans with staff to identify potential access issues
o Coordinate activities needed to gain temporary or permanent access from adjacent landowners. Negotiate terms as needed with grantor(s) of easements, and draft easement documents (either directly or with review/assistance of outside legal counsel). Coordinate signatures, and manage recording process as needed.
o Provide final easement documents and assist in updating land records system consistent with established procedures
• Support activities of land sales staff including
o Assist with division of property as needed. This may include providing legal descriptions, drafting (with assistance of outside legal counsel as needed) deeds, and recording documents.
o Coordinate, negotiate, & draft easements that must be retained or granted as the result of an impending land sale.
o Research historic ownership of property as needed
o Support applications as needed for any change in zoning or other land-use regulations
• Research existing land rights related to property owned by others
o Conduct research at local courthouses, or manage research services provided by outside contractors
o Actively work with forestry staff to obtain notes and other documentation of access rights granted informally by adjacent landowners
o Work with neighbors to clarify/modify/specify their existing easements that are used for access across company property.
• Support leasing activities to include
o As needed, assist with or take lead in negotiation of business terms of non-standard leases
o Prepare/review lease documents, coordinate regional and any national approvals, manage signature process
o Administer existing leases, including all accounting and renewals/extensions.
o Maintain lease files in accessible manner
o Maintain records of lessee compliance with insurance requirements
o Provide annual listing of existing leases as required by loan agreements
• Support ongoing operating needs related to one-time/temporary road-use, tail-hold, or similar agreements; manage issuance and receipt of other permits and licenses,
• Maintain files and records related to any reciprocal road-use agreements, including financial records related to amounts due to/from various parties
• Work with Boston-based land records manager to resolve issues related to property-tax assessments, classifications, or taxpayer status.
Qualifications
• Direct experience in legal aspects of real property ownership. This should include familiarity (at least) with deeds, title reports, easements, rights-of-way, zoning/land-use regulations, property-tax assessments, and purchase/sale transactions.
• Demonstrated ability to research ownership issues, work with external legal counsel, draft basic documents, and maintain accurate files and records.
• Must be self-directed and able to work independently, willing/able to provide high level of support to meet ongoing needs of operating managers, and able to communicate effectively with others both externally and internally throughout a geographical dispersed organization.
• Possess sufficient quantitative skills to manage financial aspects of leases and other land-related transactions.
• Negotiating skills and experience are desirable.
• Legal knowledge of prescriptive rights, adverse possession, & water-use law is desirable.
• Knowledge and understanding of land surveying is desirable.
• Good judgment and common sense are imperative.
Integrity, discretion, and respect for confidential information are absolutely essential.
Other Responsibilities
Support all necessary and appropriate requirements of the Sustainable Forestry Initiative® (SFI).
Vehicle Requirements
Participation in vehicle allowance plan is provided. The position requires the use of employeeÂ’s personal vehicle, which must be in good mechanical and safe condition. Vehicle should not be more than 5 years old (some exceptions made). Must have a current driverÂ’s license and clean MVR.

Location
One of existing Forest Capital Partners offices (Coeur dÂ’Alene Idaho or Colville Washington) to be mutually agreed with successful candidate. Position will require frequent travel to county courthouses and FCP offices in both NE Washington and Northern Idaho regions, as well as field visits to meet adjacent landowners and view physical access issues as needed.
Compensation and Benefits
This is a salaried position. Compensation includes salary, annual bonus potential, and comprehensive benefit package.
